1. Acceptance of Terms

By accessing or using ESA Center ("the Service"), operated by ESA Center ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ESA Center is an AI-powered platform that helps families manage Education Savings Account (ESA) reimbursements. The Service provides tools for uploading receipts, predicting approval likelihood, generating compliant expense descriptions, submitting claims, and tracking payouts.

3. AI-Generated Content Disclaimer

The Service uses artificial intelligence to provide approval predictions, rewrite expense descriptions, and generate suggestions. These outputs are suggestions only and not guarantees of approval by any state ESA program. You are solely responsible for reviewing and verifying all information before submitting claims to your state ESA program.

ESA Center does not guarantee the accuracy, completeness, or reliability of any AI-generated content. Approval decisions are made solely by your state ESA program administrator.

4. No Government Affiliation

ESA Center is an independent, private service. We are not affiliated with, endorsed by, or connected to any state government, state ESA program, or government agency. Our Service does not replace official program communications or requirements.

5. Account Responsibilities

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years old to use the Service.

6. Acceptable Use

You agree not to:

  • Upload fraudulent, falsified, or misleading receipts or documents.
  • Use the Service to submit claims for expenses that are not legitimately ESA-eligible.
  • Attempt to reverse-engineer, decompile, or disassemble the Service.
  • Use automated systems (bots, scrapers) to access the Service without prior written permission.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Violate any applicable local, state, or federal law in connection with your use of the Service.

7. Uploaded Content

You retain ownership of any receipts, documents, or other content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, store, and analyze your content solely for the purpose of providing the Service to you.

We will not sell, share, or use your User Content for any purpose other than delivering the Service, unless required by law.

8. Payments and Billing

Certain features of the Service may require a paid subscription. All payments are processed through Stripe. By subscribing, you agree to pay the applicable fees. Fees are non-refundable except as required by law or as described in our refund policy.

We reserve the right to change pricing with 30 days' notice to active subscribers.

9. Limitation of Liability

To the fullest extent permitted by law, ESA Center shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of ESA funds, denied reimbursement claims, or financial losses arising from your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ESA Center, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

You may delete your account at any time. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
